TERMS & CONDITIONS OF SALE & SERVICE

This business is registered as an Australian business under the legal name of Latex 42, ABN: 39 434 956 829. Latex 42 conducts its business in accordance with the Australian Consumer Law as described in Schedule 2 of the Australian Competition and Consumer Act 2010.

 

Latex 42 encourages you to read through this document, (Terms & Conditions of Sale & Service), and through its Privacy Policy before entering into a contract for sale and supply of goods and or services from Latex 42. All contracts for sale and supply of goods and services from Latex 42 are completed once your order has been shipped or collected from our studio. By using this website referred to as Latex 42.com.au, you agree to all terms and conditions of sale and service of this site. By using this website, you agree that you are of legal age and capacity to enter into a contract with Latex 42.

 

SERVICE & PURCHASE
To ensure your Latex 42 experience is positive and efficient, it encourages you to follow and confirm all selection and sizing guidelines before placing your order. Latex 42 representatives are available to answer any questions you might have regarding your intended purchase to help you make the best purchase decision for you.  Before placing an order it is important that you fully investigate the suitability of the goods for your purposes and, where the purchased items comprise latex clothing, it is your responsibility to ensure that all or any measurements provided by you to Latex 42 are accurate. Ownership of goods sold by Latex 42 does not pass to the customer until payment in full of the purchase price. 

RETURNS AND REFUNDS

Latex 42 stands by its products and in the event that a product is faulty will, at its cost, repair the product where same is repairable or if the product is not repairable will replace same or refund or credit the price paid for same as the purchaser requests subject to the following:

• Upon receipt of your shipment you should carefully examine same and, if you are not satisfied, advise Latex 42 forthwith, no later than 14 days after receipt of the goods, providing details of your dissatisfaction.

• Latex 42 is happy to exchange any of its stock items, which do not fit the purchaser, with other available stock items, subject to price adjustments if the exchange is for a different stock item, and provided that the item is returned to Latex 42 within 14 days of delivery to the purchaser in good order and condition and at the cost of the purchaser.

• Unless custom designed and manufactured goods have unrepairable faults in manufacture or materials Latex 42 will not exchange, refund or credit the purchase price.

• Latex 42 does not offer returns and/or exchanges on any of our silicone products, such as adult toys for health and safety reasons. If there is a manufacturing fault that is deemed to be a fault by Latex 42 upon inspection by us, you will be given a replacement equivalent to the value of the original purchase. The purchaser must contact Latex 42 within 14 days of delivery to the purchaser if they find a fault with the silicone product

CUSTOM DESIGNS & ORDERS

Latex 42 will design and manufacture latex clothing and accessories where it is able to meet the requirements of its customers and before undertaking such work will provide an estimate of cost and will require payment of a non-refundable deposit to be agreed with the customer sufficient to cover the costs of Computer Aided Design, cut out pattern production, purchase of specific materials and overheads. Please note that any custom goods manufactured by Latex 42 based upon inaccurate measurements provided by you will not be deemed to be faulty for the purposes of Latex 42 Returns and Refund Policy and the Australian Consumer Law. If the customer does not complete the purchase of any custom designed goods, then any deposit paid is not refundable and ownership of the goods being manufactured remains with Latex 42.

REPAIRS

Latex 42 provides repair services for all goods which it sells and for latex clothing and accessories provided by third party suppliers. If Latex 42 believes the item to be repairable it will provide an estimate of repair cost which must be accepted by the customer before commencement of repair work. Latex 42 warrants the quality of its repair work but does not accept any responsibility for any other defects whether patent or latent in any items provided by third parties.

SHIPPING
Once your order is complete, using the shipping details you have provided and payment has been made via EFT, Shopify, Squarespace, Square or Stripe, its website, or other means Latex 42 will send your parcel. To ensure that your parcel is delivered to you, it’s highly important that you check that all your shipping information is correct. If you have recently moved or you're planning a change of location, remember to update your shipping details, before you complete the order, so your goods are shipped to the right address. Latex 42 is not responsible for parcels that are not delivered if we haven't been informed of changes to the shipping address, once the package has been shipped. It is your responsibility to check all your shipping information as replacement orders, exchanges or refunds will not be issued.  Shipping alternatives and costs will be advised to you in advance and will be added to the price of the goods. Latex 42 charges for shipping at actual cost to it.  Once goods are shipped, they are at the risk of the customer.

AFTER PURCHASE SERVICE
Latex 42 is always available to help you with any questions you might have before, during or after purchase, this includes care instructions for your Latex 42 goods.

PRODUCT DISCLAIMER
Latex 42 is not responsible for any damages caused to any of its products as a result of misuse of any product purchased from it, or at public events. Latex 42 is not responsible for any physical harm, injury or otherwise, caused as a result of reckless, negligent or careless use by the customer or any third party of any product purchased from Latex 42, or public events.
